Tax Litigation: Administrative and Judicial Proceedings

In an ideal tax world, there would be no tax assessment, risk questioning, enrollment in active debt or tax enforcement. The taxpayer would pay what was legally imposed on him, collaborating with his part to support and maintain public services, and the tax authorities would collect only what was due. Unfortunately, the reality is quite different: while taxpayers are looking for legal alternatives to reduce tax burdens, tax authorities – at the federal, state and municipal levels – try to collect the amount they believe is due and which is sometimes higher than the amount collected by citizens.

In the face of this conflict of interest, it is natural that, in many cases, litigation becomes inevitable, either on the initiative of the taxpayer – to defend himself or to prevent charges he considers unfair – or on the initiative of the tax authority. In the first case, the only alternative is the judicial one, whereas in the last case, the proceedings can take place either through the administrative or the judicial one.
